Society changed, and with it, the demands on health professionals for a change in their ways of thinking and acting; thus, for example, decisions of interest to the patient's health must be joint between the health professional, the family, the caregivers and the administrators of the health benefit plans. The benefits and risks of the treatments should be assessed from the perspective of the well-informed patient, as it is the main interested in the results of them. However, in the Colombian context, we lack a normative regulatory framework for such decisions in the patient's comprehensive perioperative care. In this sense, this proposal seeks to auscultate in the Colombian legal system, towards its greater hermeneutic scope, in the assimilation of the new tendencies on the decisions and the actors of them, in the procedures that compromise the interests of the patients and their families .
