In relation between diversityand discrimination within labour law, the European Union has a crucial role in protecting the first and eliminating the second. Encouraging diversity, the communitarian norms aim each time to remove any possibility of discrimination. Nevertheless, behind the enunciation of such an objective, the European bodies interpret the norms of forbiddance of discrimination in a way in which they could not lead to the disadvantage of the very persons who are to be protected.
