There is no section of any penal code, federal or state, that includes the words" white-collar crime." Nonetheless, the term is employed widely in legal circles. Prosecutors may be assigned to a" white-collar crime unit" that typically is charged with locating and seeking redress-in forms such as injunctions, restitution, fines, or incarceration-for illegal commercial behaviors that can range from trivial matters to billion-dollar depredations. Judges not uncommonly employ the term white-collar criminal when they sentence certain types of offenders, usually persons who are well-dressed and who have been well-placed in the world of the haves as contrasted to that of the have-nots. Though they know better, the judges are likely to proclaim that their imposition of a 30-day jail term for this or that antitrust conspirator demonstrates that the courts will be no more tolerant of suite criminals than they are of street offenders.
